The Jones Act provides protection for seamen injured while working aboard vessels or on other structures in navigable waterways. Under the act, a sailor injured due to his or her employer's negligence is entitled to the cost of medical treatment and a daily stipend during recovery.
Due to the excellent benefits available under the act, the seaman must prove that his or her injury was caused by his or her employer's negligence. The employer is also able to present evidence in an attempt to prove comparative fault - that the seaman was partly to blame for his or her injury. If the employer is successful, any damages available under the act would be reduced by the degree of the seaman's fault.
